Welcome to the Charging Hub App. These Terms and Conditions ("Terms") constitute a
legally binding agreement between you ("User" or "You") and Charging Hub ("We," "Us,"
or "Our") governing your access to and use of our services, including the Charging Hub app, website, and
associated products or services (collectively, the "Services").
By accessing or using the Services, you acknowledge that you have read, understood, and agreed to be
bound by these Terms. If you do not agree to these Terms, you must immediately cease using the Services.
Definitions
For the purpose of these Terms, the following definitions apply:
- "Charging Hub" refers to the entity providing the Services, including the
Charging
Hub App, website, and related functionalities.
- "User" or "You" refers to any individual or entity accessing or using the
Services.
- "Charging Hub App" refers to the software application and related services
provided
by Charging Hub for EV charging station discovery, booking, payments, and management.
- "Charge Point Operator (CPO)" refers to the entity responsible for owning,
managing, and maintaining charging stations listed on the Charging Hub platform.
Use of the Application
By accessing or using the Charging Hub App, you agree to the following:
License to Use the App
- Charging Hub grants you a non-exclusive, non-transferable, revocable, and limited license to
access
and use the Charging Hub App solely for personal, non-commercial, and lawful purposes.
- This license does not grant ownership of the App or its content. All rights, titles, and
interests
in the App remain the exclusive property of Charging Hub and its licensors.
- You are strictly prohibited from using the App for commercial purposes without prior written
consent
from Charging Hub.
User Responsibilities
Accuracy of Information:
- You must provide accurate, complete, and up-to-date information during account registration
and
throughout your use of the Services. This includes, but is not limited to, your EVCCID
details,
vehicle type, payment information, and any required data.
Account Usage:
- You shall use your personal account only. Sharing account credentials with others is
strictly
prohibited.
- You are solely responsible for all activities conducted under your account and agree to
notify
Charging Hub immediately if you suspect unauthorized access.
Compliance with Laws:
- You agree to comply with all applicable local, state, national, and international laws,
regulations,
and ordinances while using the Services.
App Maintenance:
- You are responsible for keeping the Charging Hub App updated to the latest version to ensure
its
full functionality. Charging Hub shall not be held liable for performance issues resulting
from
the
use of outdated versions of the App.
Permitted Use
You may use the Charging Hub App solely for the following purposes:
- Locating and booking EV charging stations listed on the App.
- Managing and monitoring your EV charging sessions.
- Processing payments for charging sessions using the integrated payment system.
- Viewing and managing transaction history, usage records, or discount eligibility.
Prohibited Activities
You expressly agree NOT to:
Fraud and False Information:
- Misrepresent your EV type, EVCCID, or any other details to claim discounts or benefits you
are
not
eligible for.
- Submit false payment information or engage in fraudulent transactions.
Interference with the App:
- Attempt to reverse-engineer, decompile, copy, or tamper with the App’s source code or
security
features.
- Introduce viruses, malware, or harmful software into the App or its systems.
Unauthorized Access:
- Access, or attempt to access, another User’s account without authorization.
- Circumvent authentication mechanisms or security protocols implemented in the App.
Automated Systems:
- Use bots, scripts, or other automated tools to interact with the App, book charging
stations, or
extract data.
Illegal Activities:
- Use the App for activities that violate laws, regulations, or third-party rights, including
intellectual property rights.
Misuse of Discounts and Benefits:
- Claim discounts or benefits by providing false information about your vehicle or any other
required
details.
Content Violations:
- Upload, share, or transmit content through the App that is unlawful, harmful, defamatory,
obscene,
or otherwise objectionable.
Intellectual Property Rights
Ownership:
- Charging Hub and its licensors retain all intellectual property rights in the App, including
but
not
limited to its design, features, text, graphics, logos, software, and trademarks.
Restrictions:
- You may not copy, reproduce, distribute, or create derivative works from the App without
prior
written consent from Charging Hub.
- The Charging Hub logo, branding, and trademarks may not be used without explicit
authorization.
App Availability and Updates
Service Continuity:
- Charging Hub endeavors to maintain uninterrupted access to the App but does not guarantee
that
the
App will always be available, error-free, or compatible with all devices.
Updates:
- Charging Hub may release updates, patches, or new versions of the App to improve
functionality
or
security. Users are responsible for installing updates to ensure proper performance.
Liability for Misuse
Charging Hub reserves the right to take the following actions against Users who violate these
Terms:
- Account Suspension or Termination: Accounts engaging in prohibited
activities,
fraud, or misuse may be suspended or permanently terminated.
- Legal Action: Charging Hub may pursue legal remedies against Users engaging
in
unlawful or harmful activities.
- Financial Penalties: Users who claim unauthorized discounts or benefits may
be
retroactively charged the full session price and face additional penalties.
User Data and Privacy
Charging Hub collects and processes user data in accordance with its Privacy
Policy.
By
using the App, you consent to the collection, storage, and processing of your data as detailed
in
the
Privacy Policy.
Users are responsible for safeguarding their login credentials and ensuring the accuracy of their
account
information.
Limitations on Use
Charging Hub reserves the right to impose usage limits, such as the number of bookings per day,
to
ensure
fair use of the Services. Users exceeding such limits or engaging in disruptive behavior may
face
restrictions or penalties.
Feedback and Suggestions
Any feedback or suggestions submitted by Users become the sole property of Charging Hub. Charging
Hub
reserves the right to use such feedback without obligation to compensate or recognize the User.
Third-Party Services
The App may contain links to third-party websites or services. Charging Hub does not endorse or
guarantee
the accuracy, reliability, or availability of such services. Users interact with third-party
services at
their own risk, and Charging Hub shall not be held liable for any issues arising from their use.
Charging Hub's Position and Limitation of Responsibility
Intermediary Role
Charging Hub operates as an intermediary platform connecting Users with Charge Point Operators
(CPOs).
Charging Hub does not own, operate, or maintain any charging stations.
Technical Issues
Charging Hub is not responsible for interruptions, malfunctions, or failures at charging
stations. Such
issues are the sole responsibility of the Charge Point Operator.
Damages
Charging Hub disclaims all liability for damages to vehicles, equipment, or property during
charging
sessions.
Account Security and Responsibility
User Responsibility for Account Security
Confidentiality of Credentials
- You are solely responsible for maintaining the confidentiality of your account credentials,
including but not limited to your username, password, and any security codes associated with
your
account.
- Sharing or disclosing your account credentials to any third party is strictly prohibited.
Any such
sharing will be deemed a violation of these Terms, and you will bear full responsibility for
any
consequences arising from such actions.
Responsibility for Account Activity
- All activities conducted through your account, regardless of whether they are authorized by
you,
will be deemed to have been performed by you.
- You acknowledge that if you fail to maintain the confidentiality of your credentials,
unauthorized
individuals may gain access to your account, and any resulting actions, including the
consumption of
value, credits, or unauthorized usage of services, will be your sole responsibility.
Safeguarding Against Unauthorized Access
- You agree to take all reasonable precautions to prevent unauthorized access to your account.
These
include, but are not limited to:
- Use of a strong and unique password.
- Regularly updating your password.
- Avoiding access to your account on shared or public devices.
- Ensuring that your device and app are protected by security measures, including
antivirus
software and device lock mechanisms.
Reporting Unauthorized Access
- If you suspect or become aware of any unauthorized access to your account or any breach of
its
security, you must notify Charging Hub immediately at [support email] or [support phone
number].
- You must provide all relevant details, including the nature of the unauthorized access,
date, and
time of occurrence, and any actions you have taken to secure the account.
- Charging Hub will investigate the reported breach and may temporarily suspend or lock your
account
during the investigation to prevent further unauthorized access.
Charging Hub’s Position on Account Security
No Identity Verification of Login Activity
- Charging Hub does not verify the identity of the individual logging into the app using your
credentials. Any person who successfully logs into the app with your username and password
will be
treated as you for the purposes of these Terms.
- It is your responsibility to ensure that your credentials are not disclosed to unauthorized
individuals.
Limitation of Liability for Unauthorized Access
- Charging Hub is not liable for any losses, damages, or unauthorized transactions resulting
from the
misuse or unauthorized access of your account caused by your failure to safeguard your
credentials.
- This includes, but is not limited to, the unauthorized use of discounts, credits, coupons,
or any
value stored within the app.
Assistance in Cases of Unauthorized Access
- While Charging Hub is not liable for unauthorized access caused by user negligence, we will
make
reasonable efforts to assist you in recovering your account. This may include:
- Temporarily suspending your account to prevent further unauthorized activity.
- Resetting your account credentials, including issuing a new password or requiring
additional
verification steps.
Prohibited Actions Related to Account Security
You agree that you will not engage in any of the following actions related to your account
security:
- Sharing Account Access: Providing your login credentials to any third
party,
including family members, friends, or colleagues.
- Impersonation: Attempting to gain access to another user's account or
impersonating
another individual while using the app.
- Tampering with Security Features: Attempting to bypass or disable security
measures
implemented by Charging Hub to protect user accounts and data.
- Fraudulent Activity: Using your account to commit fraud, claim unauthorized
discounts, or misrepresent information for personal gain.
Charging Hub’s Rights Regarding Account Security
Monitoring of Account Activity
- Charging Hub reserves the right to monitor account activity for suspicious or unauthorized
activity.
This includes, but is not limited to:
- Excessive failed login attempts.
- Unexpected usage patterns, such as access from multiple geographic locations in a
short
period.
- Potential misuse of coupons, discounts, or other account-related benefits.
Suspension or Termination of Account
- Charging Hub reserves the right to suspend or terminate your account without prior notice
if:
- Unauthorized access or misuse of the account is detected.
- You are found to have violated these Terms or engaged in prohibited actions.
- Your account poses a security risk to other users or the Charging Hub platform.
Recovery of Losses
- If any unauthorized access to your account results in financial loss to Charging Hub,
including the
misuse of discounts, credits, or fraudulent activity, Charging Hub reserves the right to
recover
such losses from you. This may include:
- Retroactive billing for unauthorized discounts or credits consumed.
- Legal action to recover damages caused by your negligence or intentional misconduct.
Data Security Measures Implemented by Charging Hub
Charging Hub is committed to protecting your account and personal data through the following
measures:
Encryption
- All sensitive data, including login credentials and payment information, is encrypted during
transmission and storage using industry-standard encryption protocols.
Two-Factor Authentication (If Applicable)
- Charging Hub may implement optional or mandatory two-factor authentication (2FA) for added
account
security. 2FA will require you to verify your identity using a secondary method, such as a
code sent
to your registered email or phone number, in addition to your password.
Secure Login Practices
- Charging Hub requires secure login practices, including the use of HTTPS protocols and
secure
sessions to prevent unauthorized interception of credentials.
Regular Security Audits
- Charging Hub conducts regular audits and updates to its systems to identify and mitigate
potential
vulnerabilities in its platform.
Indemnification by User
You agree to indemnify and hold Charging Hub harmless from any claims, losses, damages,
liabilities, or
expenses (including reasonable legal fees) arising from:
- Your failure to maintain the confidentiality of your account credentials.
- Unauthorized access or misuse of your account caused by your negligence.
- Any fraudulent or unlawful activities conducted through your account.
User Acknowledgment
By using the Charging Hub App and creating an account, you acknowledge and agree that:
- The security of your account is your sole responsibility.
- Charging Hub has implemented reasonable security measures to safeguard your data and account
but
cannot guarantee protection against all potential threats.
- You will promptly report any unauthorized access or suspicious activity to Charging Hub.
Return and Refund Policy
Charging Hub operates as a provider of digital services for accessing and managing EV charging
sessions.
This section outlines the policies governing refunds, cancellations, and dispute resolution. By
using
the Charging Hub App, you agree to these terms regarding returns and refunds.
General Policy
Non-Refundable Services
- Charging Hub provides services on a post-payment model, where users are
charged
based on the electricity consumed during a completed charging session.
- Completed Charging Sessions: Refunds are generally not
applicable
for completed charging sessions, as the user benefits from the electricity provided during
the
session.
Exemptions to the Non-Refundable Policy
Refunds may be issued under the following limited circumstances:
- Technical Issues: If a charging session cannot begin or is interrupted due
to a
technical fault with the charging station that prevents the user from consuming electricity.
- Double Billing: If the user is accidentally charged more than once for the
same
charging session.
- Unauthorized Transactions: If the user provides evidence of an unauthorized
or
fraudulent transaction made through their account.
Refund Eligibility
To be eligible for a refund, the following conditions must be met:
- The refund request must be submitted within 7 days of the charging session
in
question.
- The user must provide sufficient documentation or evidence to support the refund request,
such as:
- Screenshots of the issue (e.g., error messages in the app).
- Payment receipts showing the amount charged.
- Photos or videos of the charging station, if applicable.
Refund requests submitted after 7 days will not be considered, except under extraordinary
circumstances
(e.g., prolonged technical outages confirmed by the Charge Point Operator).
Process for Requesting a Refund
Users may request a refund by following these steps:
- Submission of Refund Request
- Log in to the Charging Hub App and navigate to the support section.
- Select "Refund Request" and complete the required form, providing details such as:
- Date and time of the charging session.
- Charging station location.
- Description of the issue.
- Alternatively, users may email their refund request to [support email], including
the
relevant
information outlined above.
- Acknowledgment of Request
- Charging Hub will acknowledge receipt of the refund request within 7
business
days
via email or in-app notification.
- Investigation
- Charging Hub will investigate the request in collaboration with the relevant Charge
Point
Operator
(CPO).
- The investigation may take up to 10 business days to verify the
validity of
the
request, depending on the complexity of the issue and the response time of the CPO.
- Resolution and Refund Issuance
- If the refund request is approved, the refund will be issued to the original payment
method
used for
the transaction within 5-10 business days of approval.
- If the request is denied, the user will be notified of the reasons for the denial
and
provided with
any applicable next steps (e.g., appealing the decision).
Disputes Related to Charging Sessions
If a user believes they have been wrongly charged due to technical issues, errors, or other
problems,
they may submit a dispute for review.
Dispute Submission Process
- Disputes must be submitted through the Charging Hub App or via email to [support email]
within
7 days of the charging session.
- The user must provide supporting evidence, as outlined in Section 5.2.
Investigation and Resolution
- Disputes will be investigated in collaboration with the Charge Point Operator.
- Charging Hub will provide a resolution within 14 business days of receiving
the
dispute, which may include:
- A full or partial refund.
- An explanation of why no refund is warranted.
Refunds for Discounts and Promotions
Refunds are not applicable to any session where a discount, coupon, or promotional credit was
applied,
except in cases of:
- Technical issues preventing the charging session from starting.
- Fraudulent or unauthorized transactions.
In such cases, any refund issued will only cover the amount actually paid by the user (excluding
the
value of the discount or promotional credit applied).
Refund Limitations
Refunds may be limited or denied under the following conditions:
- User Error: Refunds will not be issued for errors caused by the user,
including but
not limited to:
- Selecting the wrong charging station or connector.
- Failing to follow instructions for initiating or completing a charging session.
- Connectivity Issues: Refunds will not be issued for interruptions caused by
the
user’s device, such as loss of connectivity, low battery, or malfunctioning hardware.
- Force Majeure: Charging Hub is not responsible for service interruptions
caused by
events beyond its control, such as natural disasters, power outages, or governmental
actions.
Special Considerations for Subscription Plans (If Applicable)
If Charging Hub offers subscription plans for charging services, the refund policy for
subscription fees
will be governed by the following terms:
- Subscription Cancellation: Users may cancel their subscription at any time,
but
refunds will only be issued for unused portions of the subscription period if the
cancellation
occurs within the first 14 days of the billing cycle.
- Non-Refundable Services: Any services already consumed under the
subscription plan
are non-refundable.
Liability of Charge Point Operators
Charging Hub acts solely as an intermediary between the user and the Charge Point Operator (CPO).
As
such:
- Any technical faults, malfunctions, or other issues related to the charging station itself
are the
responsibility of the CPO.
- While Charging Hub will assist in facilitating communication with the CPO, it is not liable
for
damages, interruptions, or losses resulting from the CPO’s failure to maintain or
operate the
charging station.

Finality of Refund Decisions
All refund decisions made by Charging Hub are final and binding, subject to applicable laws and
regulations. Users retain the right to pursue further legal remedies if they believe a refund
has been
wrongfully denied, but such actions must comply with the dispute resolution process outlined in
these
Terms.
Delivery Policy
Charging Hub provides digital services for booking, accessing, and managing EV charging stations.
This
Delivery Policy outlines how our services are delivered, the conditions of delivery, and the
responsibilities of both Charging Hub and the User. By using the Charging Hub App, you agree to the
terms set forth in this Delivery Policy.
Nature of Services
Digital-Only Services
- Charging Hub operates as a platform to facilitate access to EV charging stations. No
physical
products or goods are delivered to the User.
- Services delivered include:
- Access to a network of EV charging stations.
- The ability to locate, book, and manage charging sessions via the Charging Hub App.
- Digital payment processing for charging sessions.
- Session history, usage records, and account management tools.
Service Activation
- The service is considered "delivered" when:
- The User successfully connects their EV to the charging station.
- The charging session is activated and authenticated via the Charging Hub App.
- Any issues preventing activation or delivery of the service must be reported to Charging Hub
immediately for resolution (see Section 6.5).
Booking and Session Delivery
Charging Station Availability
- Charging Hub provides real-time information on the availability of charging stations.
However,
availability may change due to unforeseen circumstances, such as:
- Technical faults at the charging station.
- Occupancy by another user or vehicle.
- Temporary outages or maintenance by the Charge Point Operator (CPO).
- Users are encouraged to verify the availability of a charging station before starting a
session.
Session Start
- The delivery of the charging session begins when:
- The User connects their EV to the charging station.
- The charging station is authenticated and authorized through the Charging Hub App.
- Electricity begins flowing to the EV.
- Users must follow the instructions provided in the app and at the charging station to
successfully
initiate the session.
Session Completion
- The charging session ends when:
- The User manually stops the session through the app or at the charging station.
- The EV battery is fully charged, or the User’s preset limit (if applicable) is
reached.
- The session is automatically stopped due to time limits, technical issues, or other
conditions set by the CPO.
- After session completion, the User will receive a digital receipt and session details via
the
Charging Hub App.
Service Delivery Limitations
Technical Issues
- Charging Hub is not responsible for failures or delays in service delivery caused by
technical
issues at the charging station, including:
- Hardware malfunctions.
- Communication errors between the station and the app.
- Power outages or network connectivity issues.
- If a session cannot be started or is interrupted due to technical issues, the User must
report the
issue immediately to Charging Hub or the Charge Point Operator (see Section 6.5).
Force Majeure
- Charging Hub is not liable for disruptions in service delivery caused by events beyond its
control,
including but not limited to:
- Natural disasters.
- Regional power outages.
- Governmental actions or restrictions.
- Acts of vandalism or sabotage affecting the charging stations.
User Error
- Charging Hub is not responsible for service failures caused by User errors, including:
- Incorrectly selecting a charging station or connector.
- Failing to follow app instructions or on-site guidance.
- Disconnecting the vehicle prematurely or before the session is complete.
- Device-related issues, such as app malfunctions due to outdated software or hardware
problems.
Payment and Billing for Service Delivery
Real-Time Billing
- Users are billed based on the electricity consumed during the charging session and
applicable
service fees, as displayed in the Charging Hub App.
- The final amount due is calculated and delivered to the User at the end of the charging
session.
Delivery of Payment Receipt
- A digital receipt will be issued immediately upon the completion of a charging session and
delivered
via:
- In-app notification.
- Email to the registered email address (if applicable).
- The receipt will include details such as the location of the charging station, session
duration,
electricity consumed, and the total amount charged.
Pre-Payment (If Applicable)
- For some charging stations or services, a pre-payment may be required to secure a booking.
Pre-payments will be applied to the final billing amount.
Reporting Issues with Service Delivery
Immediate Reporting
- If the User is unable to start, continue, or complete a charging session due to technical
issues or
other problems, they must report the issue immediately to:
- Charging Hub customer support via the in-app support feature.
- The Charge Point Operator, using the contact information provided at the charging
station.
Resolution Process
- Charging Hub will investigate reported issues in collaboration with the Charge Point
Operator to
determine the cause and provide a resolution.
- If the issue is determined to be caused by the charging station or the app, the User may be
eligible
for:
- A refund or credit for the affected session (see Section 5: Return and Refund
Policy).
- Assistance in completing the charging session at an alternative station, if
available.
- The investigation process may take up to 10 business days, depending on the
complexity of the issue.
User Responsibilities for Service Delivery
Users are required to fulfill the following responsibilities to ensure successful service
delivery:
Proper Use of the App
- Users must ensure that their Charging Hub App is updated to the latest version and
functioning
correctly.
- Users must provide accurate account information, including valid payment details, to
facilitate
service delivery.
Compliance with Charging Station Instructions
- Users must comply with all instructions provided in the app and at the charging station,
including:
- Properly connecting the EV to the charging station.
- Ensuring the EV is compatible with the station’s connector type and power
output.
- Adhering to safety guidelines and regulations.
Timely Session Management
- Users must monitor their charging sessions and disconnect their vehicle promptly once the
session is
complete to avoid idle fees or excessive use charges (if applicable).
Liability Disclaimer
Charging Hub’s responsibility for service delivery is limited to ensuring the proper
functionality
of the app and facilitating access to charging stations. The following disclaimers apply:
- Charging Hub is not responsible for the operational status, maintenance, or performance of
the
charging stations, which are managed by the Charge Point Operators.
- Charging Hub disclaims all liability for losses or damages caused by:
- Faulty or damaged charging equipment.
- User negligence or failure to follow instructions.
- External factors beyond Charging Hub’s control (e.g., power outages,
vandalism).
Privacy Policy
Charging Hub is committed to safeguarding your privacy and ensuring the protection of your personal
data.
This Privacy Policy outlines the types of information we collect, how we use it, and your rights
regarding your data. By using the Charging Hub App and related services, you consent to the
collection,
processing, and handling of your data as described herein.
Information We Collect
We collect the following types of information to provide, improve, and secure our services:
Personal Information
- Account Information: Name, email address, phone number, and other contact
details
provided during account registration.
- Payment Information: Credit/debit card details, billing address, and
transaction
history.
- Vehicle Information: EVCCID (Electric Vehicle Communication Controller
Identifier),
vehicle type, and registration number.
Usage Data
- App Interactions: Data about your interactions with the app, including
features
accessed, session duration, and error reports.
- Charging History: Session start and end times, electricity consumption,
charging
station location, and payment details.
- Device Information: Device type, operating system, app version, IP address,
and
unique device identifiers.
Location Data
- Real-time location data is collected to:
- Identify nearby charging stations.
- Provide navigation and location-based services.
- Enhance app performance and location accuracy.
- User Control: You may disable location services in your device settings;
however,
this may limit certain app functionalities.
Cookies and Tracking Technologies
- We use cookies, web beacons, and similar technologies to collect information when you use
our
website or app. These include:
- Session Cookies: To maintain your logged-in status.
- Analytics Cookies: To monitor usage patterns and improve app
performance.
- Advertising Cookies: To provide personalized promotions and
advertisements.
- User Options: You can control cookies through your browser settings, but
disabling
them may impact your experience with the app.
How We Use Your Information

Service Delivery
- To create and manage your account.

Legal and Compliance
- To comply with applicable legal obligations, law enforcement requests, or court orders.
- To detect and prevent fraudulent activities, unauthorized access, or security breaches.
How We Share Your Information
We do not sell your personal data to third parties. However, we may share your information with
the

Service Providers

- Processing payments (e.g., payment gateways and processors).
- Operating and maintaining charging stations (e.g., Charge Point Operators).

Legal and Regulatory Authorities

Accurate and Complete Payment Information
- Users must provide accurate, complete, and up-to-date payment information (e.g.,
credit/debit
card
details, billing address) during account registration or at the time of payment.
- Charging Hub is not liable for delays or failures in processing payments caused by
inaccurate or
incomplete payment information provided by the user.
Payment Methods
Accepted Methods
- Charging Hub accepts the following payment methods:
- Credit and debit cards (e.g., Visa, Mastercard, American Express).
- Digital wallets (if enabled within the app, e.g., Apple Pay, Google Pay).
- In-app prepaid balances, credits, or vouchers (if applicable).
Payment Authorization

Currency

- If your payment method is linked to a non-HKD account, your bank or payment provider may

Transaction Confirmations
- Upon successful processing of a payment, Charging Hub will provide a digital receipt via:

- Email to the user's registered email address (if applicable).
Timing of Payments
Post-Charge Payments
- Payments are processed automatically in HKD after the completion of each
charging
session.
- The total amount due will be calculated based on:
- The duration of the session (if applicable).
- The energy consumed during the session (e.g., kWh).
- Any idle fees, surcharges, or taxes.
Pre-Payment (If Applicable)
- For certain charging stations or services, Charging Hub may require pre-payment or
authorization
of
a temporary hold in HKD on the user’s payment method before starting
a
session.
- Any unused portion of the pre-payment will be refunded or adjusted against the final billing
amount
after session completion.
Subscription Plans (If Applicable)
- If Charging Hub offers subscription plans, users will be billed in advance for the
subscription
period (e.g., monthly, annually) in HKD. Payments for subscription plans
are
non-refundable except as required by law or explicitly stated in these Terms.
Late Payment Policy
Payment Deadline
- All payments for charging sessions must be completed within 48 hours of
session
completion if automatic payment processing fails (e.g., due to insufficient funds or expired
payment
methods).
Late Payment Fees
- Failure to settle the outstanding amount within the 48-hour payment window will result in
the
following penalties:
- A late payment fee equal to 7% per annum (calculated daily) on the
outstanding amount in HKD until payment is received in full.
- A minimum administrative fee of HKD 50 may also be applied to cover
processing costs associated with overdue payments.
Suspension of Services
- Charging Hub reserves the right to suspend or restrict access to its services, including the
ability
to book or use charging stations, for accounts with overdue payments until all outstanding
amounts,
including late fees, are fully settled.
Debt Recovery
- For accounts with overdue payments exceeding 30 days, Charging Hub may
initiate
debt recovery actions, including:
- Sending reminders and notices to the registered email or phone number.
- Referring the account to a third-party debt collection agency.
- Pursuing legal action to recover outstanding amounts, with the user being
responsible
for
any additional legal or administrative costs incurred by Charging Hub.
Refunds and Adjustments
Refunds for Overpayments
- If a user is charged more than the actual amount due for a session (e.g., double billing),
the
overcharged amount will be refunded in HKD to the original payment method
within
5-10 business days of verification.
Adjustments for Technical Errors
- In cases where a technical error (e.g., incorrect session duration, erroneous kWh
calculation)
results in incorrect billing, Charging Hub will:
- Investigate the issue within 10 business days of receiving a report
from
the user.
- Issue a refund or adjustment in HKD if the error is verified.
Non-Refundable Charges

- Charging Hub’s decision regarding payment disputes is final and binding, subject to
applicable

User Responsibilities
Users are required to fulfill the following responsibilities to ensure smooth payment processing

avoid penalties:
- Maintain Valid Payment Methods:
- Users must ensure that their payment method is active, valid, and has sufficient
funds
in
HKD to cover charges.
- Users must promptly update their payment method in the Charging Hub App if it
expires or
becomes
invalid.
- Monitor Transactions:
- Users should regularly review their transaction history in the app and report any
discrepancies or
unauthorized charges immediately.
- Timely Resolution of Payment Issues:
- If a payment fails or is declined, users are responsible for resolving the issue and
completing the
payment within the specified 48-hour window to avoid late fees.
Charging Hub’s Rights
Charging Hub reserves the following rights with respect to payments:
- Automatic Payment Attempts:
- Charging Hub may attempt to process payment automatically multiple times within the
48-hour
payment
window if the initial attempt fails.
- Adjust Charges for Errors:
- Charging Hub reserves the right to adjust or correct billing amounts in cases of
technical
or
administrative errors.
- Suspend or Terminate Accounts for Non-Payment:
- Charging Hub may suspend or permanently terminate accounts with repeated or
unresolved
payment

Special Discounts and EVCCID Registration

registration of Electric Vehicle Communication Controller Identifiers (EVCCIDs) with Charging Hub.
By
participating in any discounts or registering your EVCCID, you agree to the terms below.

- Only one discount or promotional code can be applied per transaction unless otherwise

- Discounts will not apply to sessions that violate these Terms or involve fraudulent
activity.
Revocation of Discounts
Charging Hub reserves the right to revoke or cancel discounts if:

- The user is found to have claimed the discount through fraudulent means or in violation of

Terms.

To access certain features and benefits, users may be required to register their Electric Vehicle
Communication Controller Identifier (EVCCID) with Charging Hub. The process and terms for EVCCID

- An EVCCID (Electric Vehicle Communication Controller Identifier) is a
unique
identifier assigned to an electric vehicle’s communication controller. It is used to
authenticate charging sessions and facilitate personalized services.
- Registering your EVCCID allows Charging Hub to verify your vehicle’s eligibility for
specific
discounts, promotions, and government programs.
Benefits of EVCCID Registration
Registering your EVCCID with Charging Hub provides the following advantages:
- Access to exclusive discounts and loyalty rewards tied to your specific vehicle.
- Faster authentication at compatible charging stations, reducing waiting times.
- Improved session tracking, including detailed usage reports and performance metrics.
- Eligibility for government programs, subsidies, or partner-specific offers supported by
Charging
Hub.
How to Register Your EVCCID
Users can register their EVCCID through the Charging Hub App by following these steps:
- Log in to your Charging Hub account.
- Navigate to the “Vehicle Registration” section in the app
settings.
- Enter the following details:

Terms for Discounts and EVCCID Registration

new

is registered, previous discounts or benefits may no longer apply.

Fraud Prevention

- Charging Hub reserves the right to suspend or terminate accounts found to be engaging in
fraudulent

- The registered EVCCID is found to be invalid or unverifiable.

reissued or extended.

registration benefits, or promotional offers at any time without prior notice.
- Updates to these programs will be communicated through the Charging Hub App or via email
notifications.
Limitation of Liability

of
its services, including the Charging Hub App, charging stations, and any related digital or physical
infrastructure. By using Charging Hub’s services, you agree to the terms set forth below.
No Warranty of Uninterrupted Access
- Charging Hub provides access to its services, including the Charging Hub App and charging
network,
on an “as-is” and “as-available” basis.
- Charging Hub does not guarantee that:
- The Charging Hub App will operate without error, interruption, or downtime.
- Charging stations will always be available, functional, or meet your specific
charging
needs.
- Transactions, including payments or session starts, will be processed without delays
caused
by third-party systems (e.g., banks, Charge Point Operators).
Limited Liability for Service Delivery
- Charging Hub acts as an intermediary between users and Charge Point Operators (CPOs) to
facilitate
access to EV charging stations. Charging Hub is not directly responsible for:
- The physical operation, maintenance, or reliability of individual charging stations.
- Technical faults, malfunctions, or outages at charging stations.
- Delays or interruptions caused by third-party service providers, including CPOs and
payment
processors.
- While Charging Hub strives to ensure accurate information in the app (e.g., availability,
pricing,
and station condition), it does not warrant the accuracy, reliability, or completeness of
such
information. Users rely on this information at their own risk.
Indirect, Consequential, and Incidental Damages
To the maximum extent permitted by law, Charging Hub is not liable for any indirect,
consequential,
incidental, or special damages arising out of or related to the use or inability to use its
services.
This includes, but is not limited to:
- Loss of profits, revenue, or anticipated savings.
- Loss of use or inability to access a charging station.
- Damage to your vehicle or equipment caused by charging station faults or user error.
- Costs incurred for alternative charging arrangements or transportation.
- Business interruptions, loss of goodwill, or reputational damage.
Limitation of Direct Liability
- Charging Hub’s total liability for any claims, losses, or damages arising from or
related
to
its services, whether in contract, tort, or otherwise, is limited to the total amount paid
by

user for the specific charging session or service that gave rise to the claim.
- If no payment has been made for the service in question, Charging Hub’s liability is
limited
to HKD 500.
Exclusions of Liability
Charging Hub is not liable for any losses, damages, or claims arising from the following
circumstances:
User Misconduct
- Misuse of the Charging Hub App, charging station equipment, or any related infrastructure.
- Failure to follow the instructions provided in the app, at charging stations, or by the
vehicle
manufacturer.
- User negligence, including leaving the vehicle plugged into a station beyond the
session’s
completion, resulting in idle fees or other penalties.
Technical Issues Beyond Control
- Issues caused by third-party systems, including:
- Payment processing failures by banks or credit card providers.
- Downtime, malfunctions, or outages at charging stations managed by CPOs.
- Network interruptions affecting app functionality or charging station connectivity.
- Failures caused by the user’s device, such as outdated software, hardware
malfunctions, or
lack of internet connectivity.
External Factors
- Events outside Charging Hub’s reasonable control, including but not limited to:
- Natural disasters or extreme weather conditions.
- Power grid failures, blackouts, or unstable electricity supply.
- Acts of vandalism or sabotage affecting charging stations or other infrastructure.
- Government actions, regulatory changes, or legal restrictions.
User Responsibility for Damages
Users are responsible for any damages caused by their actions, negligence, or failure to follow
proper
procedures. This includes but is not limited to:
- Damage to charging station equipment caused by improper use or failure to follow
instructions.
- Costs incurred by other users or Charging Hub as a result of misuse of services or
fraudulent
behavior.
- Penalties, fines, or fees resulting from violations of applicable laws, regulations, or
charging
station terms.
No Liability for Third-Party Services
Charging Hub’s services may include links, references, or integrations with third-party
services,
such as:
- Charge Point Operators (CPOs) managing charging stations.
- Payment processors facilitating transactions.
- EV manufacturers or partners providing related services.
Charging Hub is not liable for:
- The quality, reliability, or availability of third-party services.
- Damages or losses caused by third-party actions, omissions, or failures.
Specific Exclusions for Vehicle Damage
Charging Hub is not liable for any direct or indirect damage to your vehicle, battery, or
charging
equipment caused by:
- Faulty or incompatible charging station hardware.
- Overcharging, undercharging, or improper charging practices.
- User error, including failure to unplug the vehicle after session completion or improper
connection
to the charger.
- Pre-existing defects or issues with the vehicle or its charging system.
Indemnification
By using Charging Hub’s services, you agree to indemnify, defend, and hold harmless
Charging
Hub,
its affiliates, directors, employees, and partners from any claims, damages, losses,
liabilities, or
expenses (including legal fees) arising from:
- Your misuse of the Charging Hub App or charging stations.
- Your violation of these Terms, local laws, or regulations.
- Claims made by third parties as a result of your actions or omissions.

- Users may choose to terminate their Charging Hub account at any time by:

- Selecting the option to delete or deactivate the account.
- Confirming the termination request.
Consequences of Voluntary Termination
- Upon termination of the account:
- All active or pending charging sessions will be canceled.
- Any unused credits, discounts, or rewards associated with the account will be
forfeited

are non-refundable unless otherwise stated in these Terms.
- Users will lose access to their account history, including past charging session
records,
unless prior arrangements for data export are made.
- Users are responsible for settling any outstanding balances or charges incurred before
termination.
Charging Hub-Initiated Termination
Charging Hub reserves the right to suspend, restrict, or permanently terminate a user’s
account
under the following circumstances:
Violations of Terms of Service
- Charging Hub may terminate an account if the user violates any of the terms set forth in
this
agreement, including but not limited to:
- Misuse of the Charging Hub App or charging stations.
- Providing false, inaccurate, or misleading information during registration or while
using
the service.
- Failure to pay outstanding balances or repeated payment failures.
- Sharing or transferring account credentials to unauthorized persons.
Fraudulent, Illegal, or Abusive Activity
- Charging Hub may terminate an account without prior notice if the user is found to be
engaging
in:
- Fraudulent activities, such as registering fake EVCCIDs or using stolen payment
methods.
- Illegal activities, such as tampering with charging equipment or violating local
laws at
charging stations.
- Abusive behavior toward Charging Hub staff, Charge Point Operators (CPOs), or other
users.
Prolonged Inactivity
- Charging Hub may terminate accounts that have been inactive for a period of 24
months or longer. In such cases:
- Users will be notified via email or in-app notification at least 30
days
before termination.
- Users may reactivate their account by logging in and confirming continued use.
Force Majeure or Service Discontinuation
- Charging Hub reserves the right to terminate accounts in the event of service
discontinuation or
unexpected circumstances beyond its control (e.g., changes in legal requirements, cessation
of
operations).
Notice of Termination

Settlement of Outstanding Balances

- Referral to a debt collection agency.
- Legal action to recover the outstanding amount, with the user being responsible for

Forfeiture of Credits and Rewards
- Any unused credits, rewards, or discounts associated with the account will be forfeited upon
account
termination. These are non-transferable and non-refundable unless explicitly stated in the
terms

Appeals and Reinstatement
